4. Booking and Payment Terms

All event bookings require a signed service agreement and deposit to secure your date. Payment schedules will be outlined in your individual service contract. We accept various payment methods including credit cards, bank transfers, and certified checks. Final payments are typically due 30 days before your event date unless otherwise specified in your contract.

5. Cancellation Policy

Cancellation policies vary depending on the type and scale of your event. Generally:

  • Cancellations more than 90 days before the event: 50% refund of deposits paid
  • Cancellations 30-90 days before the event: 25% refund of deposits paid
  • Cancellations less than 30 days before the event: No refund available
  • Force majeure events may be subject to different terms as outlined in individual contracts

6. Intellectual Property Rights

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Party Perfect Canada and is protected by copyright and other intellectual property laws. Event designs and concepts created for your event remain our intellectual property unless specifically transferred in writing.

7. Limitation of Liability

Party Perfect Canada's liability is limited to the total amount paid for our services. We are not liable for indirect, incidental, or consequential damages. Our responsibility is limited to the professional planning and coordination services outlined in your service agreement. We are not liable for vendor performance, venue issues, or circumstances beyond our reasonable control.

8. Privacy and Data Protection

We are committed to protecting your privacy and personal information. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms of Service. We implement appropriate security measures to protect your information and comply with applicable privacy laws.

9. Vendor Relationships

While we work with trusted vendors and suppliers, Party Perfect Canada acts as a coordinator and is not responsible for vendor performance, quality of goods, or services provided by third parties. All vendor contracts are separate agreements between you and the respective vendors, though we facilitate these relationships as part of our service.

10. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, labor disputes, or other unforeseeable events that make performance impossible or impracticable.

11. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved through binding arbitration in accordance with Canadian law. The arbitration will take place in the province where the services were primarily performed. Both parties agree to attempt mediation before proceeding to arbitration.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms are governed by the laws of Canada and the province in which services are provided. Any legal proceedings must be brought in the appropriate courts within Canada. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
